Property Division

Dividing your marital assets and debts is one of the most important issues affecting your financial future. In Florida, your marital assets and debts are equitably divided, which means that the Courts divide marital assets and debts in a manner that is fair, but not necessarily equal. The Court has discretion in awarding assets and debts based upon the conduct of either party.

The key elements to consider equitably dividing marital assets and debts are:

  • Identifying marital assets and debts 
  • Valuing each item of the marital estate (including real estate, jewelry, retirement accounts, and more)
  • Distributing the marital assets and debts after they are valued and presented in court

Parties may resolve the equitable distribution of their marital assets and debts through negotiation, mediation, or litigation. Often times, parties decide to negotiate property settlement rather than leave it in the hands of the Judge to eliminate the risk of losing property if the judge doesn’t rule in their favor. We will work diligently to evaluate the circumstances of your case so that we can work to negotiate or litigate a fair share of the marital estate for you.

Do I Have to Go to Trial?


Hiring a divorce lawyer does not mean your case must be highly contested and go all the way to trial. It simply positions you to protect your interests and exercise control over the situation. A majority of the time, clients’ primary goals are to resolve any disagreements and avoid trial. In this situation, we can assist you with determining whether your case can be resolved through mediation or settlement negotiations. 


If settlement negotiations with your spouse do not achieve favorable results, we will advocate for you by litigating through the Court. Even if you do not desire to go to trial, you can turn it into a positive situation by being presented with an opportunity to achieve a better outcome than your initial goal.
